REQUIREMENTS FOR MAINTAINING AN IRRIGATION DITCH ON YOUR PROPERTY
The South and West Field Irrigation Company (Irrigation Company) has easement rights, including prescriptive rights of way, to any property with an irrigation ditch that has been installed under the proper authority of the South and West Field Irrigation Company. The property owner has an inherent obligation to maintain the ditch in a serviceable condition, to allow water to flow freely. In the event a ditch is not maintained, the property owner could be liable for damage to the ditch or other property that results from water not being able to flow along the course of the ditch. Damage to the ditch must be repaired, to the approval of the Irrigation Company, by the property owner or its agents. Irrigation ditches are not sized for, nor intended to transport, storm water. A property owner has an obligation to prevent stormwater from entering the irrigation ditch en masse. South and West Field Irrigation Company shareholders and authorities may access company-owned irrigation ditches for inspection, service, management, or other official purposes under the rules of the state of Utah that apply to rights of way.
STEPS TO TAKE IF A NEIGHBOR IS NOT MAINTAINING THE IRRIGATION DITCH ON THEIR PROPERTY
The South and West Field Irrigation Company has a long history of neighborhood cooperation. It is the obligation of each property owner to communicate with their neighbors to preserve the integrity of the irrigation system. This cooperation is critical to preventing property damage resulting from poorly maintained ditches that may result in water leaving the irrigation channel. Please work with your neighbors to resolve issues related to ditch maintenance.
In the event neighbor-to-neighbor cooperation cannot be achieved, please contact the Irrigation Company ditch master for assistance. The ditch master can also help assess ditch issues to determine responsibility for failures.

SELLING WATER SHARES
Shares can be sold to anyone in a private sale or sold to the water company which is currently paying $1,100 per share. (Price accurate as of 1/1/2022 and is based on the appraised value)
To sell your share(s) completely fill out the information on the back of the water certificate and delivery to:
- South & West Field Irrigation Company
- P.O. Box 2633
- Cedar City, UT 84721-2633
All outstanding water assessments need to be paid current in addition to a $15 transfer fee.
Old certificates will be retired, and a new certificate will be created for the new owner.
REPLACING LOST WATER CERTIFICATES
Complete a South and West Field Irrigation Company stock transfer form.
The signed, dated, and notarized form is then sent to:
- South & West Field Irrigation Company
- P.O. Box 2633
- Cedar City, UT 84721-2633
All outstanding water assessments will need to be paid in addition to a $15 certificate fee.
The old certificate will be voided, and a new certificate issued.
SELLING OR TRANSFERING SHARES OF DECEASED OWNER(S)
To transfer shares or stock, the heirs of the owner will need to provide a copy of the death certificate.
Individuals requesting stock transfer or sale will need to show authority to do so with:
- Copy of the will
- Copy of trust with trustee authorizing transfer
- Probate
- Affidavit for Collecting Personal Property in a Small Estate Proceeding (less than $100,000)
